The administrator of your personal data is Awers-Art Sp. z o.o. with headquarters in Opole at ul. Prószkowska 83/1 running the website at www.awers-art.pl .

The information obligation results from Art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (hereinafter: "GDPR" ). The basis for the processing of personal data is Art. 6 sec. 1 lit. a) and b) GDPR, i.e .:
a) the data subject has consented to the processing of his personal data for one or more specific purposes;
b) processing is necessary for the performance of a contract to which the person is a party the data subject or to take action at the request of the data subject before concluding the contract.

We receive your consent to the use of your personal data when registering on the website or by e-mail when concluding a sales agency contract.

Your personal data is used to perform contracts, and to contact you to finalize contracts, make and receive payments. The received personal data is also used for tax and accounting purposes, keeping records of offers and auctions concluded with a sale, counteracting money laundering and supporting terrorism.

The following data is necessary in order to implement the terms of the contract, by complying with generally available and generally applicable legal regulations.

PESEL number or a document confirming identity
Correspondence address, e-mail or telephone number
Bank account number
Virtual wallet number

Refusal to provide the above-mentioned personal data is tantamount to refusal to sign the contract.

We share your data with entities that keep accounting, website and IT systems. The entities are obliged to keep your personal data confidential and not to disseminate them under the contract signed with Awers-Art Sp. z o.o. We have the right to transfer your personal data to public authorities fighting fraud and abuse.

Your data is stored from the moment of signing the first contract between the parties and after its termination, for possible claims regarding signed contracts, compliance with legal provisions related to accounting, preventing fraud and abuse, recording auctions concluded with sales, up to 10 years after the implementation of the last contract, unless the law provides otherwise.

Rights of data subjects (GDPR):

1. The right to withdraw consent - legal basis: art. 7 sec. 3 GDPR.
A. Everyone has the right to withdraw the consent granted by Awers-Art Sp. z o.o. for
B. Withdrawal of consent is effective from the moment of withdrawal of consent.
C. Withdrawal of consent does not affect the processing carried out by Awers-Art Sp. z o.o. lawfully before its withdrawal.
D. Withdrawal of consent does not entail any negative consequences, however, it may prevent further performance of the contract or use of services which, in accordance with the law, Awers-Art Sp. z o.o. can only testify with consent.

2. The right to object to data processing - legal basis: art. 21 GDPR.
A. Everyone has the right to object at any time - for reasons related to his particular situation - to the processing of his personal data, including profiling, if Awers-Art Sp. z o.o. processes its data based on a legitimate interest, e.g. marketing of products and services of Awers-Art Sp. z o.o., keeping statistics on the use of individual website functionalities and facilitating the use of the website, as well as a satisfaction survey.
B. Opting out of receiving marketing messages regarding products or services in the form of an e-mail will mean an objection to the processing of his personal data, including profiling for these purposes.
C. If the objection turns out to be well founded, and Awers-Art Sp. z o.o. will have no other legal basis for the processing of personal data, the personal data will be deleted, the processing of which has been objected to.

3. The right to delete data ("the right to be forgotten") - legal basis: art. 17 GDPR.
A. Everyone has the right to request the deletion of all or some personal data.
B. The right to request the deletion of personal data is granted if:
a) personal data are no longer necessary for the purposes for which they were collected or for which they were processed;
b) specific consent has been withdrawn to the extent that the personal data were processed
c) an objection has been made to the use of the personal data for marketing purposes;
d) personal data have been processed unlawfully;
e) personal data must be deleted in order to comply with a legal obligation under Union law or the law of the Member State to which Awers-Art Sp. z o.o .;
f) personal data was collected in relation to the offering of information society services.
C. Despite the request to delete personal data in connection with the objection or withdrawal of consent, Awers-Art Sp. z o.o. may retain certain personal data to the extent that processing is necessary to establish, assert or defend claims, as well as to fulfill a legal obligation requiring processing under EU law or the law of a Member State to which Awers-Art Sp. z o.o. This applies in particular to personal data including: name, surname, e-mail address, which data are kept for the purpose of handling complaints and claims related to the use of Awers-Art Sp. z o.o., or additionally the address of residence / correspondence address, which data are kept for the purpose of considering complaints and claims related to concluded sales contracts or the provision of services.

4. The right to limit data processing - legal basis: art. 18 GDPR.
A. Everyone has the right to demand that the processing of their personal data be restricted. Submitting a request, pending its consideration, prevents the use of certain functionalities or services, the use of which will involve the processing of data covered by the request. Awers-Art Sp. z o.o. it will not send any messages, including marketing messages.
B. The right to request limitation of the use of personal data is available in the following cases:
a) in the event of questioning the correctness of your personal data - then Awers-Art Sp. z o.o. restricts their use for the time needed to verify the correctness of the data, but not longer than for 7 days;
b) when the processing of data is unlawful, and instead of deleting the data, the person requests the restriction of their use;
c) when the personal data they are no longer necessary for the purposes for which they were collected or used, but they are needed to establish, assert or defend claims;
d) due to the special situation - the protection of the interests, rights and freedoms of the person outweighs the interests that the Administrator performs when processing personal data.

5. The right to access data - legal basis: art. 15 of the GDPR.
Everyone has the right to obtain from the Administrator confirmation as to whether they process personal data, and if so. The above right includes:
a) access to your personal data;
b) information on the purposes of processing, categories of personal data being processed, recipients or categories of recipients of these data, the planned period of data storage or the criteria for determining this period (when it is not possible to determine the planned period of data processing), about the rights under the GDPR and the right to lodge a complaint with the supervisory authority, about the source of this data, about automated decision-making, including profiling, and about the safeguards used in connection with the transfer data outside the European Union;
c) obtain a copy of your personal data.

6. The right to rectify data - legal basis: art. 16 GDPR.
Everyone has the right to request the Administrator to immediately rectify incorrect personal data concerning him. Taking into account the purposes of processing, the data subject has the right to request supplementing incomplete personal data, including by submitting an additional statement by sending a request to the e-mail address.

7. The right to data portability - legal basis: art. 20 GDPR.
Everyone has the right to receive their personal data, which they provided to the Administrator, and then send them to another personal data administrator of their choice. Everyone also has the right to request that personal data be sent by the Administrator directly to such an administrator, if technically possible. In this case, the Administrator will send personal data in the form of a file in a commonly used, machine-readable format that allows the received data to be sent to another personal data administrator.

8. In the event of a person having the right resulting from the above rights, Awers-Art Sp. z o.o. meets the request or refuses to comply with it immediately, but not later than within one month after receiving it. However, if - due to the complexity of the request or the number of requests - Awers-Art Sp. z o.o. will not be able to meet the request within a month, will meet it within the next two months, informing in advance within one month of receiving the request - about the intended extension of the deadline and its reasons.

9. Anyone may submit complaints, inquiries and requests to the Administrator regarding the processing of his personal data and the exercise of his rights.

10. The person whose personal data is processed has the right to lodge a complaint with the President of the Personal Data Protection Office regarding the violation of his rights to the protection of personal data or other rights granted under the GDPR.
